When serving legal documents through the Florida Secretary of State, specific requirements must be met to ensure valid service. Most importantly, the statute authorizing substitute service (e.g., Chapter 48.161 or 48.181, Florida Statutes) must be clearly stated on the summons or cover letter. Effective immediately, the Division of Corporations has implemented new regulations that eliminate same-day service for all filings submitted by local process servers, businesses, and residents. In-person waiting for same-day confirmation is no longer permitted.
